Published 9:28am Friday, November 18, 2011 Updated 11:30am Friday, November 18, 2011A Battle Lake woman was sentenced Wednesday to two years and six and two thirds months in prison after being convicted of her fifth DWI in the last 10 years.
Linda Jo Green, 64, was convicted for first degree DWI. She was fined $50. If she commits a violation in prison or while she is on parole after her prison term, she could be incarcerated again for over a year. She had already served 201 days in jail.
Green was arrested on April 30, court records state. A deputy responded to the area around Cliff Road, near Clitherall, after a man there called and said he had seen an intoxicated woman, later identified as Green, getting into her car with a partially consumed bottle of alcohol.
The deputy soon located Green’s vehicle near the intersection of County Highway 5 and 265th Street. He pulled her over, and after she handed over her identification, the deputy learned that she had four DWI convictions since 2001 and a restricted driver’s license which prohibited the use of drugs or alcohol.
After she failed some field sobriety tests, Green was arrested and taken to jail, where her blood alcohol content was recorded at .24.
During a check of Green’s car, a three-quarters full bottle of vodka was found.
