NOTICE OF MORTGAGE FORECLOSURE SALE

THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.

NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of that certain mortgage dated February 7, 2011 executed by Glenna LaMere, a single person, as mortgagor, to Wesley Hovland, as mortgagee, and was filed for record in the Office of the County Recorder in and for Otter Tail County, Minnesota, on February 24, 2011 as Document No. A1088868;

the original principal amount secured by said mortgage being $43,300.00;

that no action or proceeding has been instituted at law to recover the debt secured by said mortgage, or any part thereof; that there has been compliance with all preforeclosure notice and acceleration requirements of said mortgage, and/or applicable statutes; that there is claimed to be due upon said mortgage, including interest to the date hereof, the sum of FORTY-SIX THOUSAND ONE HUNDRED FORTY-FIVE AND 25/100 DOLLARS ($46,145.25) and that pursuant to the power of sale therein contained, said mortgage will be foreclosed and the tract(s) of land lying and being in the County of Otter Tail, state of Minnesota, described as follows, to wit:

That part of the Northwest Quarter of the Northwest Quarter (NW1⁄4NW1⁄4) of Section Twenty-Four (24), Township One Hundred Thirty-Three (133) North, Range Forty-Three (43) West of the Fifth Principal Meridian, Otter Tail County, Minnesota, described as follows:  Commencing at the Southwest Corner of said Northwest Quarter of the Northwest Quarter (NW1⁄4NW1⁄4) of said Section Twenty-Four (24); thence North 89°59’19” East (Assumed Bearing) along the South line of said Northwest Quarter of the Northwest Quarter a distance of 340.00 feet to the Southeast corner of Lot Seven (7), Block One (1) of Country Oak Estates, on file and of record in the Office of the County Recorder in and for Otter Tail County, Minnesota, said point being the point of beginning; thence North 00°29’59” West along the East line of said Country Oak Estates a distance of 260.00 feet to the Northeast corner of Lot Six (6), Block One (1), of said Country Oak Estates; thence North 89°59’19” East a distance of 503.52 feet to the westerly line of a parcel of land recorded as Document No. 671950 in the Otter Tail County Recorder’s Office; thence South 00°11’38” West along said westerly line a distance of 259.99 feet to the South line of said Northwest Quarter of the Northwest Quarter (NW1⁄4NW1⁄4) thence South 89°59’19” West along the South Line of said Northwest Quarter of the Northwest Quarter (NW1⁄4NW1⁄4) a distance of 500.38 feet to the point of beginning.

Together with an easement for ingress and egress purposes over and across Reserve Lot A of said Country Oak Estates.

Also together with an easement for ingress and egress purposes, said easement is described as follows:  Beginning at the Northeast corner of Lot (6), Block One (1) of said Country Oak Estates; thence North 00°29’59” West a distance of 66.00 feet; thence North 89°59’19” East a distance of 66.00 feet; thence South 00°29’59” East a distance of 66.00 feet; thence South 89°59’19” West a distance of 66.00 feet to the point of beginning.

Commonly known as 21095 Country Oak Loop, Fergus Falls, MN 56537,

Will be sold by the sheriff of said county at public auction to the highest bidder on December 20, 2012 at 10:00 a.m. at the north door of the Otter Tail County Courthouse, at 121 West Junius Avenue, Fergus Falls, Minnesota, to pay the debt then secured by said mortgage and taxes, if any actually paid by the mortgagee, on the premises and the costs and disbursements allowed by law.  The time allowed by law for redemption by said mortgagor, its personal representative or assigns, is six (6) months from the date of sale.

Mortgagors released from financial obligation on the mortgage: none.

“THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.”

THE MORTGAGOR MUST VACATE THE PROPERTY IF THE MORTGAGE IS NOT REINSTATED OR REDEEMED.  THE TIME TO VACATE THE PROPERTY IS 11:59 P.M. ON
June 19, 2013.
