SUMMONS
THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
YOU, AND EACH OF YOU, ARE HEREBY SUMMONED, and required to serve upon Plaintiffs attorney, an Answer to the Complaint which is on file in the Office of the Court Administrator of the above-named Court in the City of Fergus Falls in the said County and State, within twenty (20) days after service of this Summons upon you exclusive of the day of service. If you fail to answer Plaintiffs said Complaint within the time aforesaid, the Plaintiff in this action will apply to the Court for the relief demanded in the Complaint herein. This action involves, affects or brings into question real property situated in the County of Otter Tail, State of Minnesota, described as follows;
The Northwest Quarter of the Northeast Quarter, the Northeast Quarter of the Northwest Quarter, Section 26, Township 135, Range 41, Otter Tail County, Minnesota, and that part of the Northwest Quarter of the Northwest Quarter, said Section 26, which lies easterly of the centerline of County State Aid Highway No. 35, as located and established on October 26th, 2010. Subject to County State Aid Highway No. 35 right-of way easement. Together with and subject to other easements and reservations of record, if any.
EXCEPT the following described tract.
That part of the Northwest Quarter of the Northwest Quarter, Section 26, Township 135, Range 41, Otter Tail County, Minnesota, described as follows:
Commencing at the Northwest comer of said Section 26; thence South 88 degrees 44 minutes 42 seconds East (bearing is based on Otter Tail County Coordinates – 1996 Adjustment) along the north line of said Northwest Quarter of the Northwest Quarter, a distance of 880.56 feet to the centerline of County State Aid Highway No. 35, being the point of beginning of the land to be described; thence South 06 degrees 27 minutes 36 seconds East along said centerline, a distance of 105.86 feet; thence South 88 degrees 44 minutes 42 seconds East parallel with said north line of the Northwest Quarter of the Northwest Quarter, a distance of 410.85 feet to the east line of said Northwest Quarter of the Northwest Quarter; thence North 00 degrees 01 minute 17 seconds East along said east line, a distance of 104.92 feet to the northeast comer of said Northwest Quarter of the Northwest Quarter; thence North 88 degrees 44 minutes 42 seconds West along said north line of the Northwest Quarter of the Northwest Quarter, a distance of 422.81 feet to the point of beginning. Containing 1.00 acres more or less. Subject to County State Aid Highway No. 35 right-of way easement.
Containing 88.45 acres more or less.
YOU ARE HEREBY NOTIFIED that the object of said action, among other things, is to determine the title and adverse claims to the land hereinbefore described, and to obtain the issuance to the persons entitled of new certificates of title to any of such lands which have been registered
YOU ARE HEREBY FURTHER NOTIFIED that this matter is subject to the alternative dispute resolution process as set forth in Rule 114 of the Minnesota General Rules of Practice.
