Summary of Minutes of the
OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Otter Tail County Government Services Center
November 20, 2012

The Otter Tail County Board of Commissioners:

1. Called to order the Otter Tail County Board of Commissioners meeting at 9:34 AM.

2. Approved payment of the County Board bills.

3. Closed to the public to discuss litigation involving construction of the 60-Bed Chemical Dependency Facility.  The closed session is authorized under Attorney-Client privilege, M.S. §13D.05, Subd. 3(b).

4. Closed to the public to discuss labor negotiation strategies on four open contracts with the Human Services, Nurses, and Facilities Maintenance unions.  The closed session is authorized by M.S. §13D.03.

5. Approved the appropriate County Officials’ signatures to execute an Agreement between the Minnesota Department of Health and Otter Tail County Public Health to accept a grant, in the amount of $225,000, for fiscal year 2013 to address electronic health information exchange.

6. Accepted a settlement agreement and participate in the agreement wherein Otter Tail County settled claims with Comstock Construction and Young and Associates with regard to the drainage and windows at the 60-Bed Chemical Dependency Facility.  Not included in the settlement is the HVAC claim, and arrangements will be made to pursue the claim against the engineer.  Otter Tail County will pay $35,000 to Comstock Construction to settle payments under the contract and Otter Tail County will receive from Comstock Construction and Young and Associates $192,500.

7. Approved, with no waiting period, the LG220 Application for an Exempt Permit as submitted by the Pelican Rapids Jaycees for an event scheduled for Friday, November 30, 2012.

8. Approved payment under the provision of Minnesota Statutes 609.35, in the amount of $213.00, payable to the Family Advocacy Center.

9. Approved Final Payment, in the amount of $5,840.00, to Grant Mechanical for work on the geothermal system at the Sheriff’s Operations Center.

10. Approved Change Order No. 4 from Comstock Construction dated 11/12/2012, for general construction at the Courthouse (project No. 1119) in the amount of $34,344.61.

11. Approved 7 Conditional Use Permits.

12. Approved replacing vacant positions on the Otter Tail County AIS Task Force to keep the Committee at or close to its original membership.

13. Authorized the Land & Resource Administrator to apply for a Watercraft Inspector Reimbursement Grant through the Minnesota Department of Natural Resources for the next boating season.

14. Authorized the appropriate County Officials’ signatures to approve the 2012 EMPG in the amount of $32,171.00.  This is a federal grant for funds to be used at the County level to support costs related and spent on emergency management during CY2012.

15. Approved Final Payment, in the amount of $40,179.72, payable to Mark Sand & Gravel Co. for work completed on S.A.P. 056-600-026.
16. Authorized the Chairman’s signature on the following applications for road ditch cleanouts:  David Holte, CSAH 26, Frank Haataja, CSAH 25, and John Haarstad, CSAH 88.
