Luke Anthony Wuebker, 22, of Fergus Falls, was convicted Monday for fourth degree drugs-sale-schedule 1, 2, 3 but not marijuana, a felony. He was sentenced to one year in Otter Tail County Jail. One felony count of fourth degree drugs-sale of marijuana in a school/park/public housing zone/drug treatment was dismissed.
He was also sentenced Monday to six months in jail for one felony count of fifth degree drugs-possession-schedule 1, 2, 3, 4-not small amount of marijuana-subsequent conviction.
The sentences will be served concurrently.
The fourth degree drug charge happened May 8, 2012 when Wuebker met an informant in the 800 block of Vine Street, right across from Adams Elementary School, according to the criminal complaint. Wuebker sold marijuana and a pill containing hydrocodone and acetaminophen to the informant, the report says.
The fifth degree drug charge came during a traffic stop for speeding Sept. 13, 2012, when a Cass County arrest warrant came up when the officer checked Wuebker’s driver’s license, according to the criminal complaint.
Wuebker was also sentenced July 21, 2011 for two counts of possession of a controlled substance with intent to sell in Fargo, Cass County, N.D.
