James Kent Nelson, 55, of Kathryn, N.D., was sentenced Friday, March 15, in Otter Tail County District Court to 51 months in prison for felony DWI. He pleaded guilty Feb. 7.
According to the criminal complaint, Sheriff’s deputies responded at around 2:30 a.m. Oct. 7, 2012 to an apparent rollover near State Hwy. 210 and County Hwy. 75. They found Nelson inside the vehicle, and he allegedly appeared to be intoxicated. A preliminary breath test showed Nelson’s blood alcohol level was 0.198. He was taken to the Otter Tail County Detention Facility where a breath test showed his blood alcohol level to be 0.15.
Prior convictions for Nelson include Mercer County, N.D. (DWI); New Hampshire Circuit Court – 10th Circuit, District Division in Candia July 14, 2008 (DUI); Dunn County, Wis. (operating while intoxicated) Aug. 17, 2011.
