NOTICE OF SHERIFF’S SALE

NOTICE IS HEREBY GIVEN, that under and by virtue of the Findings of Fact, Conclusions of Law, and Order for Judgment and Judgment dated April 29, 2013, in the above entitled action, a certified copy of which has been delivered to me directing the sale of the premises hereinafter described to satisfy the amount found and adjudged and due to said Plaintiff in the above entitled action from Defendants Karen L. Seviour and James A. Billups, the Sheriff of Otter Tail County, will sell at public auction to the highest bidder for cash, on July 11, 2013 at 10:00 a.m., at the Otter Tail County Sheriff’s Office, 417 South Court Street, Fergus Falls, Minnesota 56537, said county and state, the premises and real estate described in said Order located at 208 Madison Avenue North, Battle Lake, Minnesota 56515 to wit:
“Lots 1 and 2 of Block 12, in Weltzin’s Subdivision of Blocks 11 and 12, Bowman and Dunton’s Addition to the Village of Battle Lake, MN, except that part of Lot 2 lying East of a straight line drawn between a point located on the North line of Lot 2 a distance of 25 feet Northwesterly from the Northeast corner of Lot 2 and a line located on the South line of Lot 2 a distance of 20 feet Westerly from the Southeast corner of Lot 2 and also excepting the South 160 feet of Lots 1 and 2.
All of that land lying between Lines A and B, which lines A and B are described as follows: Commencing at a point on the North line of Lot 2 in Block 12 of Weltzin’s Subdivision of Blocks 11 and 12, Bowman and Dunton’s Addition to the Village of Battle Lake, MN which is 25 feet from the Northeast corner of said Lot 2 as measured in a Northwesterly direction along and over the North line of said Lot 2 and from this point of beginning, construct Line A by proceeding generally Northeasterly but exactly at right angles to the Northerly line of said Lot 2, in Block 12, Weltzin’s Subdivision of Blocks 11 and 12, Bowman and Dunton’s Addition to the Village of Battle Lake, MN, and to the point which such line intersects the shoreline of West Battle Lake.
Line B is constructed and described as a straight line which commences at a point located on the South line of Lot 2 in Block 12, of Weltzin’s Subdivision of Blocks 11 and 12, Bowman and Dunton’s Addition to the Village of Battle Lake, MN, a distance of 20 feet West of the Southeast corner of said Lot 2, thence Northerly to the shoreline of West Battle Lake intersecting a point located on the North line of said Lot 2 a distance of 25 feet Northwest of the Northeast corner of said Lot 2.”
The foregoing is intended to include and describe lands located and situated within Government Lot 4 of Section 34, Township 133, Range 40, including Corbin Avenue, either as existing or vacated within the plat of Bowman and Dunton’s Addition to the Village of Battle Lake, MN and including any and all portions of said Corbin Avenue, whether the same as been or shall hereafter be vacated.
All of the above described real property is located in Otter Tail County, Minnesota.”
