Brandon Richard Libby, 30, of Perham, was sentenced Sept. 9 in Otter Tail County District Court to 10 years of supervised probation and six months in jail for felony fifth-degree drug procure/possession/control by fraud or deceit. He pleaded guilty July 22.
According to the criminal complaint, Perham police responded to a fraud prescription report Feb. 25 at the Shopko Pharmacy in Perham.
The pharmacist received a call saying a person listed on a prescription died last month. Later, Libby called claiming to be that person, asking if the prescription was ready.
When Libby arrived, he was not given the prescription. Police caught up with Libby and arrested him.
The prescription was for 180 pills of vicodin.
