John Patrick Flatley, 53, of Perham, was sentenced Sept. 16 in Otter Tail County District Court to 365 days in jail, with 275 days stayed for two years, for gross misdemeanor possession of a pistol/assault weapon-dishonorable discharge from armed forces. He pleaded guilty July 11. In exchange for the plea, an additional charge of felony possession of a pistol/assault weapon was dismissed.
His sentence will be served concurrently with his 90-day jail sentence for felony engaging in electronic communication relating to or describing sexual conduct with a child.
According to the criminal complaint, three long rifles belonging to Flatley were found from a search warrant Jan. 18 during an investigation into Flatley for sexual electronic chat he had with someone he believed was a minor. He was also convicted in February 1998 with the U.S. Military for rape and other charges involving a minor child. He was confined for three years and dishonorably discharged from the military as a result of the conviction and sentence. It was unlawful for him to possess firearms based on his dishonorable discharge.
