Jerry Keith Sherk, 46, of Bethel, Minn., pleaded guilty and was sentenced Sept. 10 in Otter Tail County District Court to 365 days in jail, with 275 days to be stayed for six years, for gross misdemeanor DWI. In exchange for the plea, an additional count of gross misdemeanor DWI was dismissed.

According to the criminal complaint, Sherk did not move over to the left lane when a Minnesota State Trooper was pulled over with its lights on and an arrow stick motioning traffic to the left at 12:37 p.m. Aug. 31 on State Hwy. 10.

Sherk was then pulled over and a preliminary breath test revealed Sherk’s blood alcohol level to be 0.337.

Sherk also has DWI convictions Sept. 10, 2007 in Hubbard County and June 21, 2006 in Becker County.
