Lot One (1), Block One (1) of SUNNYBEND, according to the recorded plat thereof.
TO: DAVID C. BOSWELL; JULIE L. BOSWELL; KATHRYN M. ALMQUIST; PRI-MARY RESIDENTIAL MORTGAGE, INC.; MERS AKA MORT-GAGE ELECTRONIC REGISTRATION SYSTEMS, INC.; AND ANY OCCUPANTS OF THE PREMISES ABOVE DESCRIBED.
Upon receiving and filing the Report of Examiner of Titles in the above entitled matter, IT IS ORDERED, that you and all persons interested, appear before this Court on the 31st day of October, 2013 at 1:30 P.M., The Otter Tail County Courthouse, 121 Junius Avenue West, Suite 310, Fergus Falls, MN 56537-2544, and then, or as soon thereafter as said matter can be heard, show cause, if any there be, why this Court should not enter an Order as follows:
That the Registrar of Titles, upon the filing with the Registrar of a certified copy of this Order, shall cancel Certificate of Title No. 2306.0 and enter a new Certificate of Title for the land therein described in favor of Kathryn M. Almquist, with an address of 28256 Redhead Drive, Underwood, MN 56586, subject to the existing recitals, but free from all memorials appearing on the present Certificate of Title as well as the memorial of the Power of Attorney referenced in Paragraph 13 of the examiner’s report, save and except as to Documents No. 5106, 5221, 6681 and 6682, and free from the memorial of this Order. Provided, however, that said Certificate of Title shall contain the following language immediately following the legal description as now appears on the existing Certificate, to-wit:
Gladys Mae Krohn & Howard W. Krohn reserve unto themselves, their heirs and assigns an undivided fifty percent interest in and to the mineral rights on the above described real property which includes sand and gravel.
IT IS FURTHER ORDERED, that this Order be served:
(a) at least 14 days prior to such hearing upon the above named parties residing in this State in the manner provided by law for the service of Summons in a civil action;
(b) at least 14 days prior to such hearing upon any of the above named non-residents by sending a copy of this Order to such non-residents at their post office address, by registered or certified mail, with a return receipt requested;
(c) upon any party who cannot be found by two weeks published notice and by sending a copy of this Order at least 14 days prior to the hearing by first class mail to such parties at their last known address and by sending another copy of this Order at least 14 days prior to the hearing by first class mail to their address as stated on the Certificate of Title if an address is so stated.
(d) upon a dissolved, withdrawn or revoked business entity governed by Minn. Stat., Chp. 302A, 303, 317A, 322A, 322B or 323 in the manner provided by Minn. Stat. 5.25. (Note: return date on the Order to Show Cause must be at least 30 days after the date of mailing by the Secretary of State).
