NOTICE OF SALE UNDER JUDGMENT OF MORTGAGE FORECLOSURE

NOTICE IS HEREBY GIVEN: That by virtue of a judgment and decree entered in the above entitled action on July 22, 2013, that there is due to the Plaintiff the sum of Two Hundred Seventy-Three Thousand Nine Hundred Eighty-Three and 39/100 Dollars ($273,983.39) and interest thereon from July 23, 2013 at seven percent (7%) per annum.

A certified copy of the judgment has been delivered by the Court to the Sheriff of Otter Tail County, State of Minnesota, directing the sale of the premises herein after described to satisfy said judgment.

The Sheriff of Otter Tail County, at public auction, will sell to the highest bidder for cash on November 21, 2013 at 10:00 o’clock a.m. at the North Door of the Otter Tail County Courthouse, 121 W. Junius Ave., Fergus Falls, County of Otter Tail, State of Minnesota, to-wit:

Lot 1 of Inwood Beach Addition No. 3 and Reserve 1 and Reserve 2 of Inwood Beach Addition No. 3, according to the Plat thereof on file and of record, AND that part of Gov’t Lot 7 of Section 17, Township 137 North of Range 42, West of the 5th P.M. lying generally South of Inwood Beach Addition No. 3 and described as follows, to-wit:  Beginning at the southeast corner of said Government Lot 7, thence North along east line of said Government Lot 7 a distance of 64.7 feet, thence North 77°West 286 feet, thence South 82°40’ West 384 feet, thence South 73°40’ West 266 feet, more or less to the south line of said Government Lot 7, thence east on said south line to the point of beginning. Subject to existing roadway easements, AND that part of Government Lot 5 of Section 16, Township 137 North of Range 42 West of the 5th P.M., lying generally South of the North line of the existing Township road, described as follows, to-wit:  Commencing at the southwest corner of said Government Lot 5 of Section 16-137-42, thence North 45°22’ East 124.54 feet, thence North 71°47’ East 172.58 feet, thence North 88°27’ East 970.79 feet, thence North 74°59’ East 143.92 feet, thence South 3°36’30” East 331.83 feet, more or less to the south line of said Government Lot 7, thence West along the south line of said Government Lot 5 a distance of 1309.67 feet, more or less, to the point of beginning. Subject to existing Township road. EXCEPTING THE FOLLOWING:  That part of Reserve 1 of Inwood Beach Addition No. 3 described as follows:  Beginning at a point on the East line of said Reserve 1 a distance of 50.51 feet South of the NE corner of said Reserve 1; thence North 65°51’ West 316.83 feet, more or less, to the shoreline of Fish Lake; thence Northerly on said shoreline 31 feet to the Northerly line of said Reserve 1; thence South 75°00’ East 68 feet, more or less, thence South 34.17 feet to the Southerly side of a public road; thence South 75°00’ East 221.67 feet; thence South of the East line of said Reserve 1, a distance of 50.51 feet to the point of beginning together with the riparian rights pertaining to the above described tract of land which contains 0.19 acres, more or less.

ALSO EXCEPT:

Lot 1 of Inwood Beach Addition No. 3 and Reserve 2 of Inwood Beach Addition No. 3 according to the plat thereof on file and of record with the Otter Tail County Recorder AND that part of Government Lot 7, Section 17, Township 137 North, Range 42 West, Otter Tail County, Minnesota described as follows:  Commencing at the Southeast corner of said Section 17; thence North on the East line of said Section 17 a distance of 67.4 feet; thence North 77°00’ West on the Southerly side of a 33.0 foot public road for a distance of 286.0 feet to the point of beginning; thence proceeding South parallel to the East line of said Section 17 to the South line of said Section 17; thence proceeding West along the South line of said Section 17 to the point where the South line of Section 17 intersects the Southerly side of a 33 foot public road; thence in an easterly direction along the southerly side of said 33 foot public road for a distance of approximately 650 feet to the point of beginning and there terminating.
AND EXCEPT:

That part of Gov. Lot 5 of Section 16, Township 137 North, Range 42 West of the 5th Principal Meridian lying generally south of the north line of the existing township road, described as follows, to-wit:  Commencing at the southwest corner of said Government Lot 5 of Section 16, Township 137, Range 42; thence north along the west line of said Government Lot 5 a distance of 58.32 feet; thence North 45°22’ East 124.54 feet; thence North 71°47’ East 172.58 feet; thence North 88°27’ East 970.79 feet; thence North 74°59’ East 143.92 feet; thence South 03°36’30” East 331.83 feet, more or less, to the South line of said Gov. Lot 7; thence West along the south line of said Gov. Lot 5 a distance of 1,309.67 feet, more or less, to the point of beginning. Subject to existing township road, and subject to easements, restrictions and reservations of record, if any.

The Real Property or its address is commonly known as Fish Lake Road, Pelican Rapids, Minnesota

or so much thereof as shall be necessary to satisfy said judgment, the interest thereon, and the costs and expenses of such sale; subject to redemption within 6 months from the date of confirmation of said sale.  This property will be sold subject to two inferior liens.
