56-year-old sentenced for sexual assault [UPDATED]

A Fergus Falls man who sexually assaulted a woman multiple times pleaded guilty and was sentenced Monday in Otter Tail County District Court.

Johnny Garcia, 56, was sentenced to one year in jail, with 30 days to be served, and two years of supervised probation for gross misdemeanor fifth-degree criminal sexual conduct. In exchange for the plea, additional charges of felony third-degree criminal sexual conduct and felony fourth-degree criminal sexual conduct were dismissed.

According to the criminal complaint, a woman Garcia was acquainted with reported Garcia sexually assaulted her June 24, 2013 at a home in Fergus Falls. After the woman told him no in the living room, Garcia reportedly pulled the woman into the bedroom and removed her clothing and sexually assaulted her. The woman reportedly told him no three to four times.

The woman said Garcia forced her into sexual conduct on 40 occasions within nine months.
