City of Fergus Falls Ordinance NO. 86

ORDINANCE NO. 86, SIXTH SERIES

AN ORDINANCE OF THE CITY OF FERGUS FALLS,

MINNESOTA, AMENDING CITY CODE CHAPTER

3.63 BY INCLUDING ADDITIONAL PROVISIONS

RELATING TO INSURANCE AND AMENDING CITY

CODE CHAPTER 11.12 RELATING TO FINANCIAL

RESPONSIBILITY OF LICENSERS; AND, BY

ADOPTING BY REFERENCE, CITY CODE CHAPTER 1 WHICH, AMONG OTHER THINGS, CONTAINS PENALTY PROVISIONS.

THE CITY OF FERGUS FALLS DOES ORDAIN:

Section 1. City Code Chapter 3.63 (B)(3) is hereby amended to read as follows:

3. License Fee and Insurance Required. Before any license may be issued, the applicant shall pay to the City a license fee in an amount set by resolution of the City Council adopted from time to time. The applicant shall also furnish a certificate of insurance to be filed

with the City Administrator describing a general policy of liability insurance for personal injury and property damage, including products and completed operation coverage, which shall have minimum limits of not less than $100,000 for injuries to or death of one person, and not less than $300,000 for injuries to or death resulting from one accident and not less than $100,000 for property damage. The insurance policy provided for herein shall, in addition to any other requirement hereof, provide that no cancellation of the insurance contract shall be made for any cause without first having given notice to the City twenty (20) days prior to the proposed date of cancellation of the intention to so cancel. The notice shall be served upon the City Administrator by certified or registered mail, or by personal service by an agent of the company. If personal service is made, it shall be made only on the City Administrator individually. The City reserves the right to immediately revoke a license issued hereunder based upon the cancellation of the

insurance contract.

Section 2. City Code Chapter 11.12 (B)(1) is hereby amended to read as follows:

(1) This section does not apply to on-sale 3.2% malt liquor licenses with sales of 3.2% malt liquor of less than $20,000 for the preceding year, nor to off-sale 3.2% malt liquor licenses with sales of 3.2% malt liquor of less than $50,000 for the preceding year, nor does it apply to holders of on-sale wine licenses with sales of wine of less than $25,000 for the preceding year.

Section 3. Effective date. The effective date of this ordinance shall be the 30th day of June, 2008.

Section 4. City Code Chapter 1 entitled “Definitions and General Provisions Applicable to Entire City Code Including Penalty for Violation” is hereby adopted in its entirety, by reference, as though repeated verbatim herein.

THIS ORDINANCE was introduced on May 19th, 2008, and adopted by the City Council of the City of Fergus Falls, Minnesota, on the 2nd day of June 2008, by the following vote:

AYES: Schierer, Stumbo, Burt, Jensen, Shelstad, Leland, Wilson, Synstelien

NAYS: None

ABSENT: Synstelien
