Man gets 30 years for sexual conduct
Published 05:17 p.m., December 2, 2009
A Minneapolis man has been sentenced to 30 years in jail for committing multiple sexual acts with a child.
Frankie Earl Miller, 43, was sentenced Monday on one count of first degree criminal sexual conduct, multiple acts. The charge states Miller engaged in sexual penetration with a victim under age 16 on multiple occasions between September 2008 and March 2009 in Otter Tail County.
According to a criminal complaint, authorities began investigating the misconduct in early March after receiving information from Otter Tail County Human Services. Miller, who began living in Fergus Falls in September 2008, had moved to Minneapolis by late February 2009. In an interview with authorities in March, Miller denied any sexual misconduct with the victim.
He was charged with six counts of criminal sexual conduct — three in the first degree and three in the second degree — and pleaded not guilty to all counts in June.
A jury disagreed, finding him guilty of all six July 30. According to Assistant Otter Tail County Attorney Michelle Eldien, Miller was sentenced only on the most serious charge because all of the charges involved the same type of behavior with the same victim.
Miller has about eight aliases, as well as a conviction for indecent exposure from March 2006, according to the complaint. He has two instances in which he failed to register as a sex offender in connection with the 2006 conviction.
Miller will receive credit for 263 days already served.
