Man gets prison time for invasion

A Dent man has been sentenced to over four years in prison for his role in an April home invasion.
Terry Allen Stewart, 31, was sentenced in Otter Tail County District Court Monday on one count of second degree assault. According to a criminal complaint, Stewart beat a Fergus Falls man repeatedly with nunchucks after breaking into the man’s home April 27. Stewart and an accomplice, Bryan Leslie Franklin, were also accused of kidnapping a juvenile from the residence.
Stewart was sentenced Monday to 52 months in prison, with jail credit to be determined by jail staff. He had been in the Otter Tail County Detention Facility since May 1.
Additional charges of kidnapping, burglary and criminal damage to property were dropped. Franklin, who is currently in jail on assault and burglary charges, has yet to be sentenced.
Stewart will serve his sentence concurrently with that from another case. Authorities executing a search warrant at Stewart’s Fergus Falls residence Dec. 8 located several items reported missing following a burglary a few days prior, according to a complaint. The property included a digital camera, Playstation console and games, fishing rods and clothing.
Stewart pleaded guilty to receiving stolen property; additional charges of burglary, theft and illegal possession of a firearm were dismissed.

Why were charges dismissed?? These are all serious charges. If someone broke into your house, nunchucked you, robbed and kidnapped you...why aren't they charging this out?? Cutting deals with these dirtbags so you don't have to go to trial is unjust and obsurd.

Because even if he were to be found guilty on all of those charges, the sentences would most likely run concurrently, which would mean the same amount of time in jail. This way, the dirtbag goes to jail for up to 52 months (hardly a "deal"), the county saves money on not going to trial, and there is no risk that he gets off on some "reasonable doubt" with a jury. That sounds like a good deal for the County taxpayers and the victim.

Are you serious?? Look up this guys criminal history...criminalsearches.com. It's free. He has 15 criminal convictions since 1999. Including 4 felony drug convictions, 1 criminal damage, 1 DWI, 1 providing alcohol to a minor, 4 burglary charges, 1 fraud, 1 forgery, 1 theft, and 1 assault. All that on top of this last mess he got himself into. Dang straight 42 months is a deal...this wonderful citizen of our state needs to go by-by for much longer than 4+ years.
