Woman who hit attorney in crash charged with DWI

A Moorhead woman faces charges stemming from a crash that seriously injured two Fergus Falls residents in a crash Sept. 12 in Mahnomen County.

Mary Marie Osenga, 33, was charged in Mahnomen County District Court with two counts of criminal vehicular operation and two counts of fourth-degree DWI.

Osenga was the driver of a car that failed to yield. The driver of a motorcycle, attorney Daniel Madsen, 45, Fergus Falls, was seriously injured. His passenger, Kristie Meyer, 46, also was injured.

District court records show that Osenga made a left turn in front of the motorcycle on U.S. Highway 59 at the intersection of Minnesota Highway 113, the Minnesota State Patrol said. The vehicle and motorcycle collided head-on.

Neither Madsen or Meyer were wearing helmets at the time of the crash, at 11:53 p.m. on Sept. 12, according to the State Patrol.

According to court documents, Meyer suffered a skull fracture, broken legs, a broken pelvis and a crushed foot. Madsen suffered broken arms and a broken pelvis, the court documents state.

Both were taken to area hospitals. Meyer later was transported to Hennepin County Medical Center in Minneapolis. Madsen was transported to a hospital in Fargo.

Thats a terrible accident, Dan was my attorney, nicest guy you'll ever meet. Get well soon Dan and Kristie. And I hope they sue the bajesus out of the suspect.

Any damages recovered for medical bills would have to be paid back to the insurance company under the collateral source rule. They can only collect on pain and suffering, loss of income, loss of consortium, type damages. Noneconomic damages like pain and suffering has been capped by most states. Maximum amount that can be awarded in Michigan is $250,000. Doesn't matter if you suffer extreme pain from the injuries for the rest of you life. It's only worth $250,000.

Skull fracture, who says that there should not be a helmet law, I bet they wear one if they get on a murder-cycle again! Get well soon, then make sure the drunk driver gets a good long prison stay, not a pat on the hand!

It is a sad situation...but unfortunate because a skull fracture could have been avoided by wearing a helmet. Get well soon.
