Teen charged in streaking case
Published Monday, October 6, 2008
Otter Tail Country prosecutors aren’t smiling after a nearly naked teen ran through the halftime show of the Fergus Falls High School homecoming game as a prank.
The 15-year-old boy allegedly ran from one end of the field to the other wearing only tennis shoes, a military gas mask and a sombrero. The school band was performing at the time.
The boy was arrested in a swampy area near the football field about 45 minutes after the incident on Friday night. Police say the boy got cold and decided to stop hiding.
Otter Tail County Attorney David Hauser says his office charged the boy with gross misdemeanor indecent exposure. He notes there were a number of small children in the stands when the streaking happened.
The teen is being held in the juvenile detention center in Moorhead.

The Daily Journal is happy to host community conversations about news and life in Fergus Falls and the surrounding area. As hosts, we expect guests will show respect for each other. That means we don't threaten or defame each other, and we keep conversations free of personal attacks. Witty is great. Abusive is not. If you think a post violates these standards, don't escalate the situation. Instead, flag the comment to alert us. We'll take action if necessary. It's not hard. This should be a place where people want to read and contribute -- a place for spirited exchanges of opinion. I do not agree with how the authorities are handling this situation. Poor kid.

Um...he was wearing socks, too. Small children in the stands...so? I think they've seen naked before. The streaker didn't do a full frontal nudity shot, for crying out loud. Geez. Don't crucify the kid.

Anyone know what it costs the county per day to have this boy up in Moorhead? Add in the hours the county attorney's office has used up to decide to charge him, the officers' time on Friday (plus transport), and this is a HUGE WASTE of taxpayer money for a simple prank.
Personally, I am more offended by the lack of common sense on the part of the county attorney's office than a teenager's wing-wang running in the cold.

It's too bad the kid is still locked up in detention. He doesn't deserve it...although, it's probably better that he's there, rather than at home. His parents are probably the only ones who aren't laughing.

Uff, ridiculous, I think you can look back through some of Fergus Falls High Schools annuals and probably catch a few kids mooning the camera for the group senior picture, this is TOTALLY uncalled for. I am not sure what they do now days, but in years past, even kids who were caught consuming alcohol underage, got ticketed and sent home to their parents, so why is this poor kid in juvenile detention?? Incredible.... obviously a bunch of party poopers in Fergus... it was a prank....

Hey, I have a great Idea. Lets give this kid some more attention! That way every other student in the FFHS will see how easy it is to become a local celebrity. The whole idea of giving this kid an overly harsh penalty in order to discourage others from following in his footsteps has completely backfired. Now, all of a sudden, everyone wants to stick up for him and make him the "good guy."

A gas mask and sombrero??? Thats hilarious...i'm sorry i missed it. Gotta kid the credit for having the guts to try it. That was a cold night though...probably didnt have anything to be proud about laying bare naked in the trees for 45 minutes hiding from the cops. It's too bad that the county attorney's office has to go and throw the book at a 15 year old pulling a high school prank and they have to let all of the meth peddlers and drunk drives off the hook with a slap on the hand. I think this kids already been locked up longer than most drug dealers that get busted in this county.

For crying out loud. It was a streaker. What harm was done? What has happened to a little fun? Things are way out of control. Obviously, prosecutors need more to do.

No one is making him out to be the "good guy." And I'm sure he wasn't alone in planning and executing this prank. Sure, he should be punished, but he shouldn't be exploited by the powers that be.
And as far as the others that were possibly involved...bet no one finds out for sure unless they stand up behind him. That's brotherhood, baby. Our city council could learn something from that kind of courage.

Last time I checked, being nude in public is against the law. Regardless of whether it happened during a football game and is labeled as a "harmless prank." People have been streaking at sports events forever, but they also have been thrown in the clink for doing so. Have yourself a hearty guffaw, but in the meantime be prepared to pay the consequences.
Perhaps I could play a "prank" on somebody and shoot a gun at their face, but only graze their ear causing little or no harm. I would assume that everyone would be open minded about it and have a good chuckle? Or does that only apply to 15 year olds?
I guess I'll have to put the kibosh on my "nude bbq wednesdays" where I strip down to my birthday suit and grill hamburgers in my front yard. PERFECTLY HARMLESS WHY MUST YOU PERSECUTE ME?

I remember many, many years back while attending a FF Civic Orchestra concert at the Middle School Auditorium. As the orchestra was playing their selection a streaker in a ski mask wizzed by in front of everyone; in one door and out the other. I don't believe he was caught but he sure put some excitement into a ho-hum concert.
Let the kid go home.

Just another reason to conclude that the authorities and the rest of the city fathers are so closed minded and out of touch. Tough cops runnin down a streaker. Strange they didn't tase him too since it required so many officers. The game needed a little spice anyway since it was a blowout. Back in the 70's this was considered an innocent prank. Apparently, it ranks right up there with a meth bust in Fergus Falls. No wonder this city loses so many of its graduates.

anyone remember back when two on duty police officers were caught having sex?
as I remember they weren't locked up, I assume they were at least partially unclothed in the back of that squad car?
or have the Republicans actually found a way to mate with spores like mold?
it wouldn't surprise me!
the streaker 15 year should have been given a blanket or been allowed to retrieve his clothing and received a citation on his way home.
instead of being sent to a facility where employee's have been caught in the past molesting and raping minors.
yesterdays streaker is now in contact with tomorrows worst!
way to go!
watermelon, we all enter this world naked.
yeah sure, we can't just say it's ok to streak but how can you compare this to shooting at someone?
last I checked, nudity never killed anyone.
it's also illegal to hang mens and womens undergarments on the same clothesline.
there is no need for the concept of victimless crimes, and yet the craigslist guy is still free to roam the streets?
I ran into one of his former victims a few days ago.

I've seen our police taser someone before, and if they did in this instance, I would consider it excessive use of force.
the family should sue!
they really do get "gung ho" with the tasers!
they were called to the American legion one night over a bar fight and tasered a guy in the parking lot who had nothing to do with it at all because he and one of the staff were taking loudly.
even the staff member felt horrible and was trying to get the police off the patron.
while all this was going on and the patron was on the ground convulsing and wetting himself, the people involved in the bar fight (nazi skinheads) got away.
the patron was jailed for disorderly conduct after the taser spikes were pulled out of his chest, and that guy was about the size of a 15 year old too!

I thought it was as funny as everyone else and I had small children with me at the game, BUT I think we should remember IF YOU CAN't DO THE TIME, DON'T DO THE CRIME! There are consequences to your actions.
You know I don't remember all of this pitty for the "poor" guy out at pebble beach that was naked in front of all of those poor kids. In fact I think a linch mob was forming for that streaker. Is this situation different because it was a prank and not a mentally unstable person??

Don't get me wrong if I was going to vote on the punishment for this kid I would vote for the more lenient one, but I also understand why he may get the book thrown at him. I think the tone of these posting would be different if there wasn't SO many adults and parents at the scene of the crime "protecting" their children. If it was just the kids ages 5 - 17 and no adults I think there would be an uproar against him, not for him.

How sad Fergus Falls has become. One prank and the child is deemed a horrible child. I laugh at the prosecuters in this case, and feel they are taking this too far. It wasn't to long ago I was in High school here and remember quite a few pranks that were pulled and not once did any one go to Juvie for these. How many times was Atchison's house egged or tomatoed....come on a prank is a prank. But like someone else said if you are not one of the Fergus Elite you can forget about any special treatment here in Fergus. If your mommy and daddy don't work at the court house or have that last name that means something, prosecutors will prosecute you to the fullest. I can remember in high school that if your daddy was a cop here in Fergus you could do anything and get away with it. I know quite a few cops sons that have done things WAY more serious than a streak and have gotten away with it. I am so glad that I am packing up my house and leaving Fergus with my family. I am ashamed of my home town and how the elite people have chosen to run this place. I will not subject my children to this "blue brother code" and this "elite" bull crap anymore. My children should not have to put up with people like them. I am a christian and I believe that you all will have to answer to God for the way you have treated people and how you all think that you are better than everyone! If I were everyone else I would pack up my family and move...far away. I don't care if this kid streaked or not...God will forgive him and so will the rest of us. This child does not deserve a record because of one dumb mistake....but I'm sure the prosecutors here in Fergus will make him pay for the rest of his life...because they are somebody in the great bully town of Fergus Falls Minnesota!

specifically, wasn't a former police chiefs son the master mind behind a prank involving actually breaking into the high school? while another on of his sons caught with a stolen handgun from a drug dealer in the armory parking lot, only to repeatedly get in trouble for driving drunk.
while,
a certain former investigating officers son was caught running over an ex girlfriend twice in the Hillcrest parking lot? I won't mention any names, because I consider most of these people friends of mine and the later guy helped me out with a bail bond once.
I agree that sometimes people make mistakes, and I hope this streaker gets at least half the consideration these other now productive members of society got when they were teens too.

Watermelon - Did you really mean to compare this to being shot at?! If the nudity of a 15 year old boy caused you that much trauma, I suggest sticking to PG rated films and public radio. And to iloverd, Do you know any preacher's kids? Hello, just because their parents are preachers, it does not mean that they have to be perfect, their preacher parents aren't perfect either, no one is. And how can you say he was on something? Do you know him? Obviously not. Is every teen that does a stupid prank on something, not usually. People need to quit assuming that preacher's kids are suppossed to be perfect, because for the most part, they rebel.

Right on to those of you who think this is out of hand; mommydearest, fencesitter, jaime! I think that those of us with the same ideas and views about things need to really think seriously about this stuff, get together and do something to make it change. Let's make something positive happen out of this by getting together and eventually make those changes. It is those of us who have to do it. Blogging on here isn't going to help much. Although I must say, again, that it wasn't that big of a deal.

Iloverc- Obviously you dont know this kid at all. He was not on any drugs, and just because he is a preachers kid where does it say he is supposed to act like a saint? His parents did a great job raising him, it wasnt their idea for him to do this, and they understand he is just a kid and it was a misguided idea. Its not a proud moment for them but who can honestly say they can control everything their kids do? I personally know he is actually a very kind and smart kid, I dont believe one wrong act should ever completely define a person. You shouldnt judge people when you know nothing about them.

I don't think this kid made a misguided decision at all. This kid made a homecoming game rememberable , fun ,and enjoyable. I've lived in Fergus my whole life. I am ashamed this is how they treat a kid who pulled a homecoming prank. Are you all really that old and prudish or do your own lives suck so bad you can't let anyone enjoy life and have fun. I think the parents that got so upset by this should really think about how much fun they will never allow their children to have. Loosen up, have fun, enjoy life, live alittle. I think it may be time to remove your corn cob and take some lessons from this 15 year old. ENJOY LIFE abit, and most important make fun meaningful memories that last a life time and make sure you HAVE FUN DOING IT. Life is too short and serious don't let it suck you in and forget what laughing and humor are all about. If we take the kid out of our kids we have failed them. The kid had awesome taste on picking what to pull for a prank. Doesn't hurt anyone (except himself in Fergus how sad) majority laughed so hard couldn't breath , and a good old fashioned Homecoming prank most will remember, a fun memory that won't soon be forgotten. If I was this kids parents (preacher or not) I would be so proud of him for remembering how to have innocent fun , and being so selfless that he wanted to share it with so many. Your parents raised a good boy. THANKS KID !!!!

First of all, ILOVERC, what are you talking about??.........so why do you think a preachers kid is to be so perfect? Preachers kids should not have higher expectations placed upon them just because they are a preachers kid. So now kids are to be judged on the profession of the parent.....and why would he have to be on something to do what he did. WOW..............
Second, this kid is already dealing with consequences of his actions. I am sure a detention center is not a fun place to be. Give him some community service work which he could complete for the choir and band director and let it go.
Third, wow some of you people really are tough on the criminal justice system. If the cops would not have arrested him and let him go, you would all be complaining that nothing was done. Hauser is just doing his job and just because the kid was charged with an offense, does not mean this kid will end up convicted of that offense.
Chill out.

After reading so many of the Pro-Streaking comments, and a number by adults with children, it's not hard to understand why there are so many losers on the county jail web site. It's just an extension of the growing make up and mentality of this community and county. It's pretty sad that as a society we've come to accept public nudity at a high school football game as normal behavior. My 13 yeard old daughter and her friends were at the game. They didn't care for it and found nothing funny about it. On the other hand.......No, don't throw the book at the kid. It was a dumb "Kid Thing", but don't defend his action as there being nothing wrong with it either. The next thing we'll hear about is somebody steaking a local church service and then many of the posters will again get on line and tell everyone to lighten up as there's really nothing wrong with that either. For those of you adults that are bragging about having done it years ago.......it was wrong then. You just don't get it, because if you did, you wouldn't be defending it 10-20 years later. There have to be some rules and a semblance of manners, consideration and/or couth in society if you expect to have a 1/2 way decent one. Yah, I know "lighten up". I don't think so.

So now we compare drug addicts, sex offenders, thieves and dwi's to the parents/grown ups in Fergus that stand behind this kid? I dont know about everyone being so "pro-streaking" but from what I read on here, not too many were offended by the offense, more were offended on the extremity of how this is being handled. For those who have witnessed public streaking at a game, or on tv or somewhere in their lives as a prank, I dont think they were traumatized beyond recovery, nor did they go off to be drug users- or criminals because of it... (and I dont think all pranksters who have "streaked" did so because their parents were in jail). As far as accepting it as normal behavior...I dont think that is so, there have been plenty of Otter home games and there wasn't a streaker at those, so it is not the norm. Matter of fact, because it is not the norm, is why people are talking.

I think the County Attorney should be charged with wasteful Spending for even pursueing this. It happened in Alexandria and that kid was reprimanded and suspended from school for two days... end of the issue. The County Attorney was concerned that little kids were there and could be traumatized by this? What about throwing a 15 yr. old into Juvenile Detention for three nights? What about traumatizing him? If I was the parent of this kid I would be sueing the county, it's attorney and the Police Chief for their flagrant misuse of power and the county's funds. They are talking about this in Fargo/Moorhead and these three individuals are embarrassing the whole state of Minnesota with their political correctness in this issue.

I truly do not believe that what his happening to this poor kid who chose to participated in a classic homecoming prank is right. It should just be left to the school, and not involved the rest of the county. But at the same time, what he did is technically illegal, so there should perhaps be some consequence. But is it really necessary to slander the names of two men who are making the Fergus Falls community proud by making a difference in the world? I don' think so.

Unfortunately in terms of the law there are various levels of offenses in any circumstance. One of the major factors that contributes to the increase in a "level" of offense is what we call "intent." For example, someone deer hunting who "accidentally" shoots and kills a person because they did not adequately identify what they were shooting at might face second degree manslaughter charges and face up to 10 years in prison. However, someone who is deer hunting who gets in an argument with someone and then "intentionally" shoots and kills them would probably face first degree manslaughter charges and face up to 15 years in prison. I think the authorities probably need to charge this kid because it's clear he blatantly and intentionally broke the law and did so in a way that basically encouraged the police to chase and catch him. Why do streakers run? Because they know they're breaking the law and they know they're going to jail if they get caught. If streakers did not get thrown in jail when they got caught there would no longer be such a thing as a "streaker." There would just be that one guy who was standing at the football game naked.
Sure, no one was hurt in the commission of this crime, but since when is that the standard for charging people with a crime? My question is, why didn't he have a get away car waiting?

Amyo: Do you really think he knew he was breaking some kind of law??? I think his "intent" was a silly prank. If he knew it was a CRIME, he would have had a get away car and better escape plan. This whole thing has been blown way out of porportion!!!! The one thing I can see happening here is that this kid has now become a juvenille delinquent and will possibly become some kind of crimminal, because of being charged with a crime. Where if it would have been left as a prank, it would remained just that---A PRANK......

Personally, I think that anyone who does not know that public nudity is against the law should not be in the 10th grade. You think it has been "blown way out of proportion" and perhaps it has been, but many people believe the same is true of people getting in trouble or underage consumption of alcohol and the recreational use of certain illegal drugs. These are essentially victimless crimes and in most cases tend to just be "kids having fun." Yet ignorance of the law is not a defense. Should we just stop enforcing certain laws because people just don't think they are that big of a deal?

maybe if hollywierd dopetard wannabees like Cooper weren't out there offering to make this kid a star he would have known it was against the law. what kind of message would that send for a city council member to be encouraging a teen to expose himself like that? go read this over on the fergus forum if you doubt that cooper has said this. he wants to put this kid on tv for streaking.

No one cares, neocon. If I thought Cooper had a snowballs chance in hell of winning, perhaps I might. But he doesn't, so I don't.
Perhaps you should take a hint from the failing McCain campaign and realize that no one likes you when all you do is attack, attack, attack. Start to put a little bit of thought into your posts and perhaps people will be a little more open to meaningful engagement.
