Teen will not be charged with a felony

Otter Tail County prosecutors aren’t smiling after a nearly naked teen ran through the halftime show of the Fergus Falls High School homecoming game as a prank.

Otter Tail County Attorney David Hauser says his office cannot disclose what charges the boy faces. He did say gross misdemeanor indecent exposure is a charge that may be available.

The 15-year-old boy allegedly ran from one end of the field to the other wearing only tennis shoes, a military gas mask and a sombrero. The school band was performing at the time.

The boy was arrested in a swampy area near the football field about 45 minutes after the incident on Friday night. Police say the boy got cold and decided to stop hiding.

“It’s clearly something that you’re not supposed to do,” Hauser said of the incident. “Neither is it a felony matter.”

Hauser also said the incident is not something for which a sexual predator registration would be appropriate.

The teen was held in the juvenile detention center in Moorhead over the weekend. He was transported to Fergus Falls Monday afternoon to appear in Otter Tail County District Court.

what a complete waste of money ottertail county!! the kid was 15, Have his parents pick him up from the police station. He isn't going to flee. I mean my god, how on earth do you justify spending that kind of money on this...

Detention costs for the whole weekend.
Police Costs to find the kid during the game
Police costs for transportation to and from Moorhead detention
Wasted money prosecuting the case...
courts wasted time and money

I mean really, at what point don't you gie the kid a stern lectrue. The kid will probably get the worst punishement from the school and his parents. You aren't doing anything but wasting taxpayer money..

Put that money to good use, build another liquor store so you can slap more hands when you catch drunk drivers...

Its just too bad its not time to vote for a new County Attorney this year....

I'm bored with this. The worst part is that I have to go to my sons FFAYFA game tonight and listen to all of the other parents joke about if a streaker with show up at this one. Then I have to pretend to laugh.

doctipster: I totally agree! I guess times have changed, with all of the sexual predators out there, but in the 70's, __________ streaked across the football field and didn't even get punished!! I think "intent" needs to be considered here. "Intent" is a huge part of the law. Was it the kids "intent to" "expose" himself or to "streak" across the football field??? Streaking actually started in the 50's. Let's not ruin this kids life over a "joke", if that was his "intent". If his "intent" was not a joke then punish as he should be. Let the punishment fit the crime. Dollars to doughnuts, he was "dared" to this by his friends :-)

I was amazed the police actually chased the streaker, and spent 40 minutes standing around the woods waiting for him to come out, didn't they want to watch the game? Clearly taxpayers in FF are being fleeced by a bloated law enforcement budget and county prosecutors who think Ottertail County is in colonial Massachusetts.

Kudos to doctipster. This has gone too far. When I was in high school in the 70's, streaking was a fad, it was going on all over. Everyone just laughed it off and it eventually died out. tWo of my classmates streaked a football game, everyone laughed, they went home, we went home. Streaking skiiers made the papers. No one was hurt. It was just a prank, a simple prank. People need to lighten up. Laugh a little. This kid never meant to hurt anyone. When have you done something stupid first and then stopped to think about it. Get a grip Fergus Falls!!! Drop the charges!!!

i called the Ottertail county attorneys office and they told me that it was resolved and it was a done deal. they wouldn't tell me the outcome but the lady on the phone was nice but seemed a little annoyed, perhaps to many phone calls.

Someone should start a "streaker" fund as doctipster suggested on another related article, I think there actually would be people willing to bail this kid out with a dollar here and there. But I am afraid, no lawyer could defend him against all of the reserved, no-sense-of-humour people that see this as such a serious crime in the community. He and his family just need to know that a lot of this community do not think he is being treated fairly, and are willing to forgive and forget, it is Tuesday, maybe something interesting and new will show up on the record for everyone to blog about. LOL.

On a side note, it's funny how a certain Ottertail County Attorney's son was involved in breaking into the HS and going through the tunnels to the MS to go swimming. Other people who hadn't been caught but squealed on got in trouble yet this individual did not even have to go to court. Makes me go hmmmmm...

I find it really interesting also that the cops spent the time with this... A friend of mine at work had his house broke into and the cops didn't spend 15 minutes on that investigation.

i agree that it is something that has been done through all of our school years, but you have to punish him. Getting away with something like this is reserved for the kids that know how to get away.

I to called the County Attorneys office to inform them that I would likely weigh Hauser's lack of judgment on this issue heavily next time he runs for reelection. His receptionist told me the case had been resolved (as if that makes his lack of judgment excusable). I told his receptionist that I was now sure that I would not support Hauser in the future because what’s worse than his lack of judgment is his lack of conviction in the face of public scrutiny!

ALL HAZARD OUTDOOR EMERGENCY SIRENS

The Fergus Falls emergency sirens will be sounded under the following conditions:

• National Weather Service issues a severe thunderstorm warning with straight line winds 65 mph or more and/or hail one inch or larger.
• Severe thunderstorm is in area and a confirmed tornado is approaching.
• An emergency situation exists and citizens need to be warned and given instructions on how to respond to a streaker at an athletic event, such as a football game.

In all the above situations, everyone should take cover immediately and tune to local media outlets for information on the immediate threat. In the event local media is unable to broadcast, tune radios to 162.500 MHz. for possible emergency messages from the Fergus Falls Emergency Management team or the Fergus Falls Police Department.

Everyone is encouraged to have a Streaker’s All Hazard Preparedness Plan and Kit. This should always include a portable camera, a police band radio and an extra pair of pants; preferably one-size fits all.

As always, the City of Fergus Falls provides a safe and clean environment for families and individuals to plan activities, events or just to relax.

Don't forget that he made the KQRS Morning Show today also. Tommy B. was really crackin some good jokes about a guy named Monke(y).

Honestly people, we know this is 2008 with a renewed view on sexuality and indecent exposure. God forbid we should have a streaker at all future events, so yes make a public statement, but don't USE this kid as an example.

Future streakers must understand that this is 2008, wear a fleshtone speedo so as to comply with the prudity/nudity laws. Also have a friend create a distraction away from your exit point to make sure you avoid capture.

Lawmen, implement a catch and release program, if you even waste our taxpayer dollars to catch them.

There's a reason people move away from Fergus Falls seconds after getting out of school there. The police should set up speed traps on the out-skirts of town to catch the people leaving that sh*thole. They can't leave fast enough!

Streaking wouldn’t be funny if it was a standard, common occurrence. Seeing naked people where you don’t ordinarily see them is amusing. Even more amusing is watching the reaction of people who didn't expect to see a weiner flopping around in the air during a half time show. I think he did a great job of picking the event and time for the streak. What is not amusing is hearing that he could actually get charged.

Okay, I get it, something has to be done. Fine, give him a stern talk and punish him at school (since it was a school event).

I'm venturing a guess that this kid was funny and creative. (The sombrero makes me think so). Now he'll just be another scared little sheep like all the rest. Boring.

Fergus Falls / Ottertail county citizens

I think we need to take heed of who we have placed "In charge" who we've voted in and consequently who they've hired. This streaking incident as we all know is a simple joke! I agree the school will punish him enough. Hauser your arrogance drips from your tongue! You are NO better than anyone else. We all know about the movie deals and the RTC fiasco the joke we call a mall, the streaker BUT do you know some other areas our officials continue to shine at....

Here's a couple most recent.

The humane society is now hiring for a new manager at the shelter. They do these panel interviews. One of the applicants I know on a personal level she has worked as the education director for the 4th largest humane society in the country earning a prestigious teaching award and she single handedly turned that education department into a community wide resource which even included summer camps for kids. She moved to this area to raise her children next to their grandparents. Her youngest just started school and now she is ready to go back to work. SHE WAS GIVEN A WERE NOT INTERESTED LETTER!

Here's another...

There is a small family owned resort out on West Lost lake, the owners bought this small resort in 2001. In 2005 those strong winds and tornados that came through our area knocked over the sign to the resort. The owners placed a new sign in the exact same holes. Along comes the OTC DA stating they MUST move it because its in the right of way. Never mind the fact that the sign has been there for decades and decades at least 40 years. This is ofcourse only one of the many things they have been made to change since purchasing this obviously never before forced to comply with any laws resort. DID I MENTION THE PREVIOUS OWNER WAS A LAW OFFICER?

Now not to bring up you know who's name that I would never vote in but people like him almost start to look good after
seeing how current local government is handling OUR community. The people are noticing and all you elected officials should start planning fishing trips and purse parties because you I'm quite certain will have some time coming up soon.

grandma66: WAKE UP!!! It was not through the audience--it was half time on the field at a FOOTBALL game! HOMECOMING AND ALL!!! Parents, kids--big and small. However, it sounds like most of the little kids missed the streaking event--they don't pay attention at the games anyway. They just run around and irratate people!! Where in the Kummorow article does it say he ran around naked??? Uff da!! I'm starting to sound like I am on the other side and I'm not---To me it was just a cute prank probably done on a dare...All Hauser is doing is turning some innocent kid into a juvenille delinquint and future crimminal by over-reacting to a prank that should be handled by the school and the parents. ANyway, it was cold out and the guy was running fast it was not like there was anything that anyone could see, except for a bare butt--and everyone has seen those before!!

wow, what ever happened to the cops taking the kid home and giving him the lecture along with the parents then letting the school officials give him a good deal of detention helping the janitors clean restrooms? Has anyone added up the tax payer's cost to this over reaction by the Fergus Falls PD and Hauser?! Lets see...how many officers did it take to surround the wooded area in order to capture this "criminal" and what do you think the cost was to transport this "criminal" to Moorhead, keep him there from Saturday through Monday, transport him back to Fergus and then have him make a court appearance?!? Police time?? Judge's time?? Hauser's time?? Gosh, I didn't know Fergus had so much money in the budget that they needed to look for stupid ways of spending it out. Hey Houser...someone's dog crapped on my front lawn!! Send out the swat team!!

I did not say anyone in the article streaked, did I? That was your assumption. I said pulled pranks. It does not go into detail in the article what the pranks were. I'm just saying that everyone pulls pranks at one time or another. Why are some criminal and other just "pranks". The county attorney is the one who decides to pursue cases. I never heard about anyone going to juvie when those high school boys tied that kid to a flagpole. Isn't that criminal too? Should have at least been assault if nothing else.

HMMM...What happened to the streakers at Pebble Lake Golf course a few weeks ago...that didn't make the Fergus Journal and it was ADULT males. Oh HELLO Mr. Hauser. I was out golfing and I didn't expect to see nude men running around, however I was surprised by crazy streakers and I got lucky and pared that hole!

i'm pretty sure everyone has skeletons in their closets, so that's kind of a low blow in my opinion. we've all done things considered wrong. what makes them wrong is that they're against some rule or social norm. the kid streaking was funny, entertaining, and ballsy (no pun intended). but what made it entertaining was that it was against the rules, just like any streaking incident. so...shouldn't there be some consequence?

I think the true lesson to be learned here for all potential streakers is that next time put a jock strap on or a sock over it and it won't be illegal.

But if I were a streaker my accessory of choice would be one clown shoe.
It says, “Hey, here’s a guy who’s out there, doing his thing, but keeping it fun at the same time.” People respect that....

i was thinking more along the lines of just putting on a thong. I mean women get to wear them and i would have laughed just as hard... FREE THE STREAKER>> actually by now he is free, i guess i just feel that this fiasco was a complete waste of our taxpayer money...

Tell him not to do it again and send him home! This is no big deal...young kids in the stands or not. How the County Attorney's office is handling the matter is a bigger crime than streaking is! I can assure that if the people feel this kid is treated unjustly that there will be hundreds streaking through the City of Fergus Falls in support of him. Do the right thing and forget about it!!!!!!!!!!

I do not find this one bit "Funny". What are you teaching our kids if you label this as a "Prank/Joke". Let's have a young "Streaker" perform at every football game, "it's Funny", they are just kids. How many times would you tell a streaker "not to do it again" and "send him home". Forgeting about it as if it never happened is not the right thing to do. What he did was "Stupid". The legal punishment should send a message to others that this is not acceptable. As for the costs: the only one to blame here is the "Streaker", not the FFPD, Courts/Judge. I think he (streaker) should be responsible for the costs, not you and I. If this was a 35yr old man would you still consider it a Prank/Joke and send him to his parents. Regardless of age this is considered indecent exposure. I'll bet most of you would call the Police if you had someone "Streaking" through your backyard.

Yeah Tmalve there's 35 year old nudes running all over and we are teaching kids to do at an alarming rate...it's a huge problem we need to address. Every time I walk outside I see weiners everywhere. I think the majority feels the school should have been the one who punished and not the legal system. The truth is it's happened one time that I can remember.....ever.... during a school event...and it was truly a prank and not some sicko trying to rape everyone in site.

Tmalve. this is not a national/local epidemic. Fact of the matter is this kid really went out on a limb, to do a gutsy PRANK-- most teenagers wouldn't risk such a PRANK-- do you not remember being a teen? Especially at the ripe old age of 15? Would you have risked the criticism of being naked (in public--or even at home) -- with the self esteem of our youth? He was gutsy, took a risk and yes HILARIOUS, most of us believe this was not a criminal act,it was a PRANK. I really doubt we will see more episodes of streakers in the future, whether it be adults or teens. And I am sure if there was, it would be only to support this kid.

Unfortunately in terms of the law there are various levels of offenses in any circumstance. One of the major factors that contributes to the increase in a "level" of offense is what we call "intent." For example, someone deer hunting who "accidentally" shoots and kills a person because they did not adequately identify what they were shooting at might face second degree manslaughter charges and face up to 10 years in prison. However, someone who is deer hunting who gets in an argument with someone and then "intentionally" shoots and kills them would probably face first degree manslaughter charges and face up to 15 years in prison. I think the authorities probably need to charge this kid because it's clear he blatantly and intentionally broke the law and did so in a way that basically encouraged the police to chase and catch him. If he had "accidently" gotten locked out of the gymnasium and exposed himself to the entire homecoming crowd, perhaps there would not be any charges being filed.

Think about it though, why do streakers run? Because they know they're breaking the law and they know they're going to jail if they get caught. If streakers did not get thrown in jail when they got caught there would no longer be such thing as a "streaker." There would just be that one guy who was standing at the football game naked.

My question is, why didn't he have a get away car waiting?

classof76 - Can't you make your point without typing in ALL-CAPS? - It's easy to do - just press the CapsLock key to turn it off (it's a toggle switch, you know, kind of like a light switch - ON/OFF) and use the Shift key on occasion. You make good points in many of your posts, but the CAPS thing detracts from your credibility.

bucksteel: Why pick on me??? Don't talk to me like I am an idiot.I know how to use the caps lock button! You come across as a smart-a__. Others have made comments in all caps too. You must be one of those that views all caps as "shouting". I just use the all caps button it as it is so much easier with my arthritis and I don't want to look like an idiot and type in all small letters. Why would the all caps detract from my credibility?? The people who do not use any caps at all, no puctuation, and spell incorrectly are the ones that have no credibility. I am a well-educated, knowledgeable person, who grew up in Fergus Falls and at least uses punctuation and spells correctly most of the time. However, those that post on here that type like they are illiterate and make off the wall comments, I feel are the ones that have no crediblity, are wasting their time commenting,wasting the time of those who read their posts and wasting space on this "post/blog". Hopefully most of you went to school at least through 7th grade and by that time should have been taught grammar and spelling. Also, computers do come with spell and grammar check. To use spell/grammar check: Type your commments out in a "Word" document, use the spelling and grammar check and then "Copy" what you have written and "Paste" it to the comment section on the "Post a Comment". This will increase your creditbiliy, what you write will make sense, it will be easier and quicker to read and have some creditbiliy. Nuff Said!

What is "creditbiliy"? Just kidding. And I'm sorry that you suffer from arthritis. Yes, I, and much of the on-line community, view ALL-CAPS as YELLING, attention-getting, or just plain laziness (netiquette) - leading to a perceived lack of credibility. If you use "Word" as you described, you would find that it automatically capitalizes the first word of each sentence for you. Hence, no need to use ALL-CAPS or all-small-letters.
